Muchos delitos en el Código Penal de California requieren que la fiscalía pruebe que el acusado tenía una intención criminal específica al momento de cometer el acto. Sin probar la intención, no puede haber condena.

La intención específica significa que el acusado actuó con el propósito deliberado de lograr un resultado determinado. Por ejemplo, el robo requiere la intención específica de privar permanentemente al dueño de su propiedad.

La intención general solo requiere que el acusado haya pretendido realizar el acto físico que constituye el delito. El asalto simple, por ejemplo, solo requiere intención general de hacer el movimiento amenazante.
