ELDER ABUSEABUSO DE ANCIANOS BAJO PC § 368 DEL CÓDIGO PENAL

Bajo PC § 273d del Código Penal, cualquier persona que intencionalmente inflige a un niño cualquier castigo corporal cruel o inhumano o una lesión que resulte en una condición traumática es culpable de un delito mayor.

Una persona que sabe o razonablemente debería saber que una persona es un anciano o adulto dependiente y quien, bajo circunstancias o condiciones que probablemente produzcan gran daño corporal o muerte, hace cualquiera de lo siguiente:

Willfully causes or permits any elder or dependent adult to suffer physical pain or mental suffering
Willfully inflicts unjustifiable physical pain or mental suffering,
Willfully causes or permits the person or health of the elder or dependent adult to be injured while in his or her care, or
Willfully causes or permits the elder or dependent adult to be placed in a situation in which his or her person or health is endangered

PUNISHMENTS FOR ELDER ABUSE

El abuso de ancianos como delito menor se castiga con prisión en la cárcel del condado que no exceda un año, o con una multa que no exceda $6,000, o con ambas multa y prisión.
