What is the punishment for a violation of Health & Safety Code § 12072?

First offense: is a misdemeanor punishable by a fine of up to $1,000 or by imprisonment in the county jail for up to one year, or by both that fine and imprisonment.

Second offense: punishable by an additional fine of $5,000, or by imprisonment in a county jail for up to one year or by both that fine and imprisonment. The person will not be eligible for probation.
