EXTORTION
PENAL CODE § 518
Under Penal Code § 518, extortion is the obtaining of property or other consideration from another, with his or her consent, or the obtaining of an official act of a public officer, induced by a wrongful use of force or fear, or under color of official right
“Consideration” means anything of value, including certain sexual conduct, or even an image of an intimate body part
POTENTIAL PUNISHMENTS FOR EXTORTION
Extortion is a felony punishable by imprisonment for up to four years, and/or a maximum fine of $10,000
DEFENSES
- You did not receive consideration (something of value)
- You did not have any wrongful intent
