EMBEZZLEMENT

PENAL CODE § 503

Under Penal Code § 503, “Embezzlement is the fraudulent appropriation of property by a person to whom it has been intrusted.”

To be convicted of embezzlement, all of the following must be proven:

  1. Taking of property
  2. Entrusted to the defendant
  3. With the intent to permanently deprive the owner of that property

POTENTIAL PUNISHMENTS FOR EMBEZZLEMENT

Embezzlement can be charged as a felony if the value of the property is more than $950.00. If the value of the property is $950 or less, embezzlement can only be charged as a misdemeanor

DEFENSES

  • You did not intend to keep the property
  • You believed in good faith the property belonged to you
