Health & Safety Code § 11357.5
– Possession of Meth for Sale
Health & Safety Code § 11357.5(a) makes it a crime to offer to, or to actually, sell, dispense, distribute, furnish, administer, or give any synthetic cannabinoid compound, or any synthetic cannabinoid derivative, to any person.
Health & Safety Code § 11357.5(b) makes it a crime to use or possess any synthetic cannabinoid compound, or any synthetic cannabinoid derivative.
Health & Safety Code § 11357.5(a)
This is a misdemeanor punishable by:
- imprisonment in county jail for up to six months or
- by a fine of up to $1,000, or
- by both a fine and imprisonment.
Health & Safety Code § 11357.5(b)
A first offense is an infraction punishable by a fine of up to $250.
A second offense may be punished as a misdemeanor and by the following:
- imprisonment in a county jail up to 6 months,
- a fine of up to $500,
- or both
A third or subsequent offense is a misdemeanor punishable by the following:
- imprisonment in a county jail for up to 6 months,
- a fine of up to $1,000,
- or both
- The substance did not contain a synthetic stimulant
- You did not know you possessed the substance
